1. Validity of terms

Only the following terms and conditions apply in the time of order valid version for all services between G-Gear Inh. Georg-Thomas Geismar, Pater-Rupert-Mayer-Strasse 1
89257 Illertissen hereinafter G-Gear and the customer.

These are by placing an order or acceptance of the services or delivery as exclusively agreed.

Additional or different terms of business or client are considered only insofar as we expressly told them our consent in writing.

3. Conclusion

Offers of any kind are subject to change and not binding unless they are expressly and in writing as solid offers from G-Gear. All Orders shall only be accepted if they are confirmed in writing or by delivery of invoice as binding. An acknowledgment of receipt of an order does not constitute a binding acceptance of G-Gear.

The customer can order using the assigned shop system. It is necessary that the customer creates an account. It can here put products into your cart and then "buy" on the function binding order. The Terms and Conditions of G-Gear are to accept this. Otherwise, an order is not possible.

 

4. Prices and Payment

For the end user, the calculation of prices takes place, unless otherwise agreed, the prices valid on the date of order. References in the respective offer prices and shipping costs that may be found are final. They contain all price components including all applicable taxes. All prices in Euros (€) and include 19% VAT.

All offers contained in our publications (Internet, printed documents and other promotional materials) are also regarding price change and not binding.

All descriptions and price lists in our shop are very carefully and in good faith. Possible misrepresentation entitle no way to claims for damages. Subject to price changes, technical changes and improvements.

The VAT will be shown separately on invoices.

 

5. Shipping and Delivery

The delivery and the carrier will be determined by us. Delivery is made within the delivery time after receipt of full payment. If the last day of the delivery period is a Sunday or at the receiving state-recognized public holiday, so enters the next working day takes the place of this day. In the case of delivery outside Germany the delivery time may be extended.

There is no minimum order size.

Shipping is from a delivery value of 50.00 euros insured via DHL. The cost of shipping within Germany usually wears G-Gear, unless time, a separate agreement was made. In countries within and outside the EU Shipping costs are proportionately borne by the buyer. The amount is determined by the destination country, postal and weight and is the customer named separately.

 

6. Payment / Payment

- Payment by bank transfer
- Cash on pickup
- Cash on delivery (only for shipping within Germany/Austria/Switzerland; COD fee Germany: 5,60 Euro/Austria & Switzerland: 8,60 Euro)
- PayPal (excl. PayPal fee: 1.9% of the basket-amount)
- Delivery (excl. Delivery fee: 0.9% of the basket-amount)

The corresponding bank account and the corresponding data are communicated to the customer. Incumbent on the customer choice here. For payment options PayPal and delivery by the customer, the transaction fee is charged. This is stated on the invoice. Cash payments are only possible if you collect the goods.

The calculations of G-Gear are payable immediately without deduction, unless another payment date indicated on the invoice. A payment shall be considered made when the amount due has been credited to the bank account or PayPal account of G-Gear

 

7. Set-off and retention

The customer has the right to set-off only if the counterclaim is undisputed, legally established or recognized by the provider.

The customer can only exercise if it concerns claims arising from the same contract.

 

8. Warranty and liability

It is requested that the customer promptly regards the goods and if damage is found, this will be reported promptly to G-Gear. This applies particularly to damage caused by transport. G-Gear is not responsible for ensuring that the goods ordered by the customer is for the Customer's intended purpose.

In ensuring the statutory provisions apply. With new product, the warranty period 2 years from the date of delivery is.

For used goods, the warranty period is different from the statutory scheme one year after delivery of the goods. The one-year warranty period shall not apply to G-Gear attributable culpably caused damages resulting from injury to life, limb or health and grossly negligently or intentionally caused damage or bad faith of the provider, as well as recourse pursuant to §§ 478, 479 BGB.

In case of defects G-Gear provides at its option by repair or replacement. If the repair fails twice, the customer can demand reduction or withdraw from the contract at his discretion. In case of repair, G-Gear does not have to bear the increased costs incurred by the shipment of the goods to a place other than the place, provided that the shipment does not comply with the intended use of the goods.

Characteristics of the goods shall only their own details of G-Gear and the manufacturer's product description as agreed, but no other advertising, promotions and public statements by the manufacturer.

The customer is obliged to inspect the goods immediately and with due attention to the quality and quantity and obvious defects within 7 days from receipt of the goods the seller in writing, the deadline, the timely dispatch is sufficient. 9. Proof of age

When ordering cutlery (knives) G-Gear requires a certified proof of age. Forbidden is a tax to persons under 18 years.

12. Place of performance, jurisdiction and applicable law

Performance and jurisdiction for both parties is Illertissen, if both parties are merchants and jurisdiction therefore can be agreed between the parties.

For individuals / consumers no jurisdiction clause, but the legal jurisdiction applies.
